A severance agreement details the rights and responsibilities of both parties – employee and the employer – with regard to any post employment pay, benefits, non-compete obligations, etc., and usually requires that an exiting employee release any potential wrongful termination claims. A well-drafted and enforceable severance agreement will prevent an employee from suing his or her employer.
